1. Acceptance of Terms

By accessing and using Apartmatic (“Service”), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Apartmatic provides a property management platform that enables users to track maintenance, manage documents, communicate with tenants and landlords, and organize property-related information. The Service is accessible via web browser at app.apartmatic.com.

3. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable law or regulation
• Transmit any harmful, threatening, abusive, harassing, or defamatory content
• Attempt to gain unauthorized access to any portion of the Service

5. User Content

6. Subscription and Billing

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring monthly basis. Billing cycles are set at the time of subscription.

At the end of each billing cycle, your subscription will automatically renew unless you cancel it or we cancel it. You may cancel your subscription renewal through your account settings or by contacting our support team.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. You are responsible for payment of all such taxes, levies, or duties.

7. Refunds

We offer a 14-day free trial. If you are not satisfied with the Service after the trial period, you may cancel your subscription at any time. We do not provide refunds for partial months of service.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

If you wish to terminate your account, you may simply discontinue using the Service and cancel your subscription.

9. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Apartmatic makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that defects will be corrected.

10. Limitation of Liability

In no event shall Apartmatic, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Indemnification

You agree to defend, indemnify and hold harmless Apartmatic and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of the Service or your violation of these Terms.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Apartmatic operates, without regard to its conflict of law provisions.
